Bipartisan Bill to Combat Explicit Deepfakes Passes House, Awaits Trump’s Signature to Become Law

On Monday, the House of Representatives passed a bipartisan bill aimed at addressing the rising issue of deepfake pornography, a concern heightened by advancements in artificial intelligence. This legislation, known as the “Take it Down Act,” garnered overwhelming support, passing with a 409-2 vote. It is anticipated that President Donald Trump will sign it into law soon.

The Senate had previously approved the bill unanimously earlier this year. The Take it Down Act seeks to criminalize the publication of nonconsensual, sexually explicit images and videos, including those created by AI. It also mandates that platforms take down such content within 48 hours of receiving notice.

The passage of this bill is notable, given Congress’s historically slow response to technological developments. This legislative effort enjoyed significant bipartisan backing, with Senators Ted Cruz, R-Texas, and Amy Klobuchar, D-Minn., serving as the primary sponsors in the Senate. First Lady Melania Trump has also championed this cause, emphasizing its importance in her platform.

She remarked, “Today’s bipartisan passage of the Take It Down Act is a powerful statement that we stand united in protecting the dignity, privacy, and safety of our children.” Despite its success, the bill has faced criticism. Digital rights advocates have raised alarms about potential threats to free speech and privacy rights.

Rep. Thomas Massie, R-Ky., voiced his opposition, labeling the bill as a “slippery slope” that risks unintended consequences. The need for this legislation was underscored by personal stories, such as that of Texas teenager Elliston Berry. After a classmate created and shared a fake nude image of her, she and her family found it challenging to seek justice, pointing out weaknesses in existing laws.

Berry’s experience highlighted the urgent need for legislative solutions to safeguard victims of such abuses and facilitate accountability.
